if they dont find the body is it murder or a missing person? if u destroy all evedence also and they have no leads also

I'd assume if the person is merely missing, it'd be a missing person. Naturally, if there's a cause, they might look into it as a murder.

I say that if there's no evidence and no leads, then it's not anything. How can it be a murder case if you don't know if there was a murder and nothing indicates that it was one? How can it be a missing person case if you don't know if it's a missing person and nothing indicates there is one? How can it be petty theft if you don't know if petty theft occurred and nothing indicates that one ever occurred?

...but that indicates that there is a missing person. If nothing indicates there is a missing person, how can you be so sure there is a missing person?

Without evidence there would be no murder involved. They might just declare that it was an accident, or something, and presume that the person is dead.
I assume the fact is known that the person is missing.

I think missing people are only declared dead after a certain amount of time has passed. I doubt it would be declared an accident, though, if no body was found.
It'd be hard to get in this situation with no leads, though. No body and no person means the person left their house, and if that is so surely the friends would know the reason, or something like that. If by force, there'd be some evidence left behind (evidence of a struggle, etc). If willingly, surely the car could be found somewhere, and if not there'd still be some level of evidence.

I guess technically a missing person unless they find evidence or pointers that they were hurt or killed... (but there is no evidence)
